A FORMER Playboy Playmate who secretly snapped a photo of a naked woman inside a gym in Los Angeles — and posted it online — has been charged with invasion of privacy for the snap.

Dani Mathers was arrested for taking the picture at an LA Fitness in July, when she spotted an elderly woman whose physique didn’t impress the 2015 Playmate of the Year, TMZ reported.

“If I can’t unsee this then you can’t either,” Mathers posted on Snapchat along with the image.

Mathers was also banned from LA Fitness following the social media post.

Detectives from the Los Angeles Police Department eventually located the unidentified 70-year-old woman in the photo. She co-operated with investigators to have Mathers prosecuted, according to TMZ.

If convicted, the 29-year-old faces up to six months in jail. She apologised for the incident on Twitter back in July.

“I’m disappointed that she was charged with any type of violation,” Mathers’ lawyer, Tom Mesereau, told TMZ. “She never intentionally violated anyone’s privacy and never tried to break the law at any time.”

Los Angeles City Attorney Mike Feuer said body-shaming is “humiliating” and often has long-term consequences, according to the statement cited by the Los Angeles Times.

“It mocks and stigmatises its victims, tearing down self-respect and perpetuating the harmful idea that our unique physical appearances should be compared to airbrushed notions of ‘perfect,’” Feuer’s statement read.

“What really matters is our character and humanity. While body-shaming, in itself, is not a crime, there are circumstances in which invading one’s privacy to accomplish it can be. And we shouldn’t tolerate that.”

The LAPD launched an investigation after the posting following a report of “illegal distribution” of the image. Officials from LA Fitness reported the posting to police as well, the Los Angeles Times reports.
