Amanda Knox has cleared another legal hurdle and is allowed to take Italy to court over unjust murder trial.

AMANDA Knox could be heading back to the courtroom in the latest twist in the sensational murder case that has gripped the world for almost a decade.

A European court on Wednesday granted Knox — who was acquitted of the murder of British student Meredith Kercher — the right to a make a legal complaint against Italy for allegedly subjecting her to an unfair trial.

The Seattle woman was convicted, acquitted, again convicted and finally acquitted, along with her ex-Italian lover Raffaele Sollecito, by Italian courts in March 2015 of sexually assaulting and murdering Ms Kercher, who had been her flatmate.

Ms Kercher, 21, was fatally stabbed in the Perugia apartment the women shared in November 2007 in what authorities claimed was a drug-fuelled sex game gone wrong.

She had been stabbed 47 times and had her throat slashed.

Last September, Italy’s top court faulted prosecutors for presenting a flawed case against Knox and Sollecito, saying it threw out their convictions for the murder partly because there was no proof they were at the crime scene.

The European Court of Human Rights’ [ECHR] decision has been conveyed to Italy to allow it to begin preparing its defence, the BBC reported.

Among Knox’s allegations are that, in the period preceding her first trial:

— She was subjected to hours of questioning without access to a translator, despite her limited grasp of Italian.

— She was questioned without being provided a lawyer.

— She was subjected to inhumane treatment including “degrading slaps to the head.”

One of Knox’s lawyers, Luciano Ghirga, told the BBC: “The court’s acceptance of the appeal is great news. It’s difficult to get cases accepted. I can’t say it gives me any satisfaction, however, as so much suffering has already been caused.”

Knox, now aged 28, was in Perugia on an exchange from her home in Seattle when the gruesome murder occurred. She served four years in prison after her initial conviction before being released on appeal and then definitively acquitted last year.

Knox told the ECHR she underwent hours of questioning without an interpreter or a lawyer, and that her interrogators slapped her on the head.

She retains a conviction for slandering a bar owner who she falsely accused of being the killer. She later said that claim had been extracted under duress.

Along with Sollecito, she was definitively acquitted of Kercher’s murder in March 2015 when Italy’s high court ruled there had been “major flaws” in the investigation.

Ivory Coast-born drifter Rudy Guede was jailed for the murder in 2008 but, in a decision that was to have serious implications for Knox and Sollecito, the judge in his trial ruled he could not have acted alone.

Knox had been studying in Perugia, Italy, for only a few weeks before the murder.

The original case against her was she convinced Sollecito to join her in a sex game that lead to the murder of Kercher.

The Italian media portrayed Knox as a sexual demon lacking emotions, earning the nickname “Foxy Knoxy”.

Knox claims she was at Sollecito’s flat on the night of the murder and returned in the morning to find strange signs throughout the house.

Ms Kercher’s body was lying on the floor, covered by a blood-soaked doona with knife wounds around her neck.

The night before Ms Kercher went to the apartment of her English friend for dinner and watched the movie The Notebook. She returned home at 8.45pm. By 12.50am she was dead.

Her body was discovered after police came to the apartment when her mobile phone was found in a neighbour’s garden.

DNA evidence was found on Ms Kercher, and it was confirmed she had sex before she died. This led to the arrest of Rudy Guede, an acquaintance of both Knox and Kercher, who was then charged with the murder. His bloody handprint was also found at the scene.

In 2008 he was sentenced to 30 years in jail.

Prosecutors said Ms Kercher was held down and stabbed after she rejected attempts by Knox, Sollecito and Guede, to involve her in the game.

Knox then allegedly staged a robbery to cover up the crime. No DNA evidence implicating Knox or Sollecito was discovered at the scene.

A knife found in Sollecito’s apartment was linked to the murder. It was claimed DNA of Ms Kercher was discovered on the knife. Experts said the trace on the knife was so small it could not be used as evidence and independent reviews of the DNA were denied by the judge.
